"I Know She's Not Okay," Says NeNe Leakes

Kim Zolciak's 15-year-old son, KJ Biermann, faces seven felony counts in an Alpharetta, Georgia assault case, and his legal team is fighting to keep it in juvenile court

Reality television has survived plenty of messy headlines. Few of them carry the weight of a felony docket involving a cast member's teenage son.

That is where Kim Zolciak finds herself right now. The Real Housewives of Atlanta alum's eldest son, Kroy "KJ" Biermann Jr., is facing seven felony charges tied to an alleged assault at a Georgia gym. And on Saturday, her former castmate NeNe Leakes said out loud what fans had already suspected.

Leakes appeared on the Big Tigger Morning Show Friday and told listeners she had checked in on Zolciak personally. "I know that's a tough time and I know she's not okay," Leakes said, noting she wanted to make sure Zolciak was holding up. The two women have history.

Leakes and Zolciak famously feuded during their time on The Real Housewives of Atlanta, but are currently on good terms and friendly with each other.

KJ Biermann is the eldest son of Zolciak and former NFL linebacker Kroy Biermann. He is the oldest son of Kroy Biermann and Kim Zolciak, with the former couple also sharing two other children. He was arrested last month.

He has remained at Atlanta's Metro Regional Youth Detention Center since his August 17 arrest, stemming from an alleged April 23 encounter at a Life Time Fitness location in Alpharetta. Both teenagers involved were the same age at the time.

A Fulton County grand jury handed down the indictment days later.

Prosecutors charged him with aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16. Because of the severity of those charges, he is not being treated like a typical 15-year-old defendant.

Georgia's SB440 statute pushes certain violent felony allegations involving minors straight into adult superior court, which is why his case landed there in the first place.

Friday's bond hearing turned into something much bigger than a routine procedural stop. Deputy District Attorney Caitlin McGillicuddy told the court the alleged victim suffered what she called a "documented physical injury," according to a report from the hearing, and she also described the alleged conduct as "predatory."

Then came the part nobody saw coming. McGillicuddy revealed that investigators found video evidence on KJ's phone allegedly showing him having sex with an underage relative, with footage that reportedly showed "multiple encounters" involving "predatory and derogatory" language.

Prosecutors tied it to a juvenile matter from the previous year that had never been made public, one that reportedly ended in probation.

His attorney, Jason Sheffield, pushed back hard and fast. "The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case," Sheffield said. He offered his own account of what actually happened.

"The matter arose from inappropriate, crude behavior involving two middle-schoolers," Sheffield said. By his telling, it led to group counseling and reunification, not a criminal conviction.

On the current case, the defense keeps returning to one point. The alleged victim was examined the following day at a North Fulton hospital, and there was no evidence of male DNA found in her mouth or vagina, per the police report. For Sheffield, that absence of physical evidence is the whole ballgame. No DNA, he argues, means a case built entirely on competing accounts.

The judge ultimately granted release. Bond was set at $200,000, with the judge saying he won't be allowed to use social media or a cell phone, and can't contact anyone under the age of 16. He is confined to house arrest under GPS monitoring and required to attend school virtually.

None of it resolves the bigger legal question hanging over the case. Sheffield has already filed to move the matter out of adult court entirely. Attorneys filed the motion in Fulton County Superior Court seeking a transfer to juvenile court and confidential proceedings, days after the grand jury indictment came down.

His argument leans on how differently the two systems weigh a case like this. "The adult system asks principally what punishment an offense deserves," Sheffield wrote in the filing. "The transfer statute asks a different question: What should happen to this child?"

Zolciak has stayed mostly quiet since her son's arrest, aside from one early statement. "The allegations being made against my son are nothing short of reckless and deeply troubling," she said, adding that he "categorically denies ever being involved with this woman or engaging in the conduct she has alleged." She was seen leaving Friday's hearing alongside daughter Brielle Biermann. Neither spoke to reporters.

A ruling on the juvenile transfer request is still pending. KJ is expected to enter a not guilty plea to all charges at his arraignment on October 14. Until then, a case with an alleged teenage victim keeps colliding with a fanbase that built its whole personality around this family's drama. That mix isn't going away quietly.
